Basics of Terms

  • Criminal Justice system - Code of Criminal Procedure or Criminal Procedure Code (CrPC) – 1973.
  • Chapter 5 of the CrPC deals with the arrest.
  • Article 22 - Protection of a person during arrest or detention.
  • Sec 57 of CrPC - No Detention of a person in custody for more than 24 hours without producing before a magistrate.

Difference between Police & Judicial custody

  • Police custody - person is confined at a lockup or remains in the custody of the Police officer.
    • When a person is arrested by police.
      • Interrogate the suspect in the police station.
      • Detention – Maximum of 24 hours.
  • Magistrate - remand the person for a period of maximum 15 days.
  • After lapse of 15 days - person may be further remanded to judicial custody.
  • Judicial custody - person is detained under the purview of Judicial magistrate.
    • Accused is lodged in central or state prison.
    • Judicial custody - extend up to 60 or 90 days.
  • Police Custody - Investigating authority can interrogate a person.
  • Judicial custody - There will be no interrogation unless court permits.
  • In police custody - Person has various rights like Right to legal counsel, right to be informed of the grounds, etc.
    • Responsibility of the police to ensure all these rights.
  • In the case of judicial custody – the accused will be in jail.
    • Prison Manual will govern the routine conduct of the person.
  • Judicial custody, the person can apply for bail as per chapter 33 of the crpc.
  • No Undertrial person can be in judicial custody beyond half of the time period of his/her prescribed maximum punishment.

  • Part of the Union Budget 2022-23.
  • Budget of the scheme - Rs.6,600 crore for a period of 2022-23 to 2025-26.

  1. To fund the Infrastructure in convergence with the spirit of PM Gati Shakti scheme.
  2. To Support social development projects based on the needs of the NER.
  3. To enable livelihood activities for youth and women;
  4. To fill the development gaps in various sectors.

PALNA Scheme :Basics of the Scheme

  • Mission Shakthi – Umbrella scheme of Ministry of Women and Child Development.
    • Aim - Safety, security, and holistic empowerment of women.
  • Implementation - 15th Finance Commission period of 2021-22 to 2025-26.
    • National Creche Scheme reorganized under Palna Scheme.
  • Palna, a sub-scheme ‘Samarthya’ of ‘Mission Shakti’.

Features of the Scheme

  1. Focus on children of age 6 months - 6 years of working women in rural and urban areas.
  2. Women are employed for a minimum period of 15 days in a month, or six months in a year.
  3. Availability of Creche facility.
    • 7.5 hours a day & 26 days a month to aid the working women.
  4. Fee details of the Scheme.
    • Given at the subsidized rate.
    • Charges Rs 20 a month per child for families below the poverty line families.
    • Non – BPL families, it is between Rs 100-200 a month.
  5. Funding details of the scheme.
    • Centrally sponsored Scheme.
    • 60% from Union Government
    • 30% from State Government.
    • 10% from individual NGOs.

Objectives of the Scheme

  • Providing Quality crèche care facility.
  • Support nutritional, health, and cognitive development of children.
  • Enable mothers to take up gainful employment and will lead to Empowerment of women.

Key Services offered by the scheme

  • Sleeping facility.
  • Early stimulation for children below 3 years of age.
  • Pre-school education for children between the ages of 3 to 6 years.
  • Supplementary nutrition (to be locally sourced).
  • Growth Monitoring, health check-ups, and immunization in convergence with POSHAN 2.0.
